1. About these terms

These terms apply to every purchase made through the FORS documents and audit page: the Risk Assessment Pack, the Safe System of Work Pack, the Driver Handbook, the Complete FORS Toolkit, the free sample pack (together, the “Products”) and the Remote FORS Micro-Audit (the “Audit”).

By completing a purchase you agree to these terms. Please read them first.

2. Who can buy

The Products and the Audit are sold to businesses for business use. By buying, you confirm that you are buying for the purposes of your business or trade.

If you are buying as a consumer, for purposes unrelated to a trade or business, nothing in these terms affects your statutory rights. Please see section 11.

3. Prices and payment

Prices are shown in pounds sterling on the FORS page. We are not currently VAT registered, so no VAT is added. If that changes, we will say so on the page before you buy.

We may change prices at any time, but a change will not affect an order you have already paid for. If we discover a pricing error, we will tell you and give you the choice of buying at the correct price or cancelling for a full refund.

Payments are taken by Stripe, our payment provider. We do not see or store your card details.

4. How a contract is formed

When you complete checkout you are making an offer to buy. A contract between us is formed when we confirm your payment and make your download available (for the Products) or confirm your consultation (for the Audit). We may decline or cancel an order, for example if we cannot verify the payment. If we do, we will refund anything you have paid.

5. Delivery of the Products

As soon as your payment is confirmed you are taken to a download page, and the same download links are emailed to the address you give at checkout, usually within a few minutes. Please check your spam folder and make sure the email address is correct.

Each download link lasts 7 days and can be used up to 5 times, so please save your own copy of the files straight away. If a link expires or stops working, contact us during your update period (see section 8) and we will send a new one. If you have not received your links within one working day, contact us.

6. Licence

When you buy a Product, we grant you a non-exclusive, non-transferable licence to use it within your own company (a single-company licence). You may:

• edit the documents, add your logo and company details, and change the wording to suit your operation;
• print the documents and share them with your own employees, drivers, customers and auditors as part of running your business.

You may not:

• resell, sub-license, share, publish or distribute the documents, or any edited version of them, to anyone outside your company;
• use them for another company, including a group company, without a group licence;
• remove our copyright notices where they appear.

We own the copyright and all other rights in the Products. If you operate more than one company, contact us about a group licence. We may end your licence if you break these terms.

7. Free sample pack

The free sample pack is licensed on the same terms as the Products, for use within your own business. You may not redistribute it.

8. Updates

Each pack and the Driver Handbook include 12 months of updates from the date of purchase. If we revise a document during that period, for example because legislation, official guidance or good practice changes, we will make the updated version available to you at no extra cost. We will usually notify you by email.

Updates are revisions to the documents you bought. We do not promise to review every document on a fixed timetable, and we are not required to create new documents. After 12 months we may stop providing updates, or offer them as a paid renewal.

9. Customised versions

If you order a customised version, you must give us accurate company details and any logo you want used. We apply them to the documents. Please check the finished documents carefully, because you are responsible for deciding whether they suit your operation. We will correct any mistakes we make in applying your details.

10. The Remote FORS Micro-Audit

The Audit is a fixed-price remote pre-audit review. It consists of a phone consultation followed by our review of the documents you send us. After your payment we will contact you, usually within one working day, to arrange the consultation. Our feedback will tell you what we found to be in place, what we found to be missing and what we recommend you address first.

The Audit is not a FORS audit. It does not award or renew FORS accreditation, it is not carried out on behalf of FORS, and we cannot guarantee that you will achieve or keep accreditation. FORS accreditation is awarded only by FORS following an audit by an approved FORS audit provider.

You agree to give us accurate and complete information and to send us the documents we ask for. Our feedback is based only on what you send us and on what you tell us, and reflects our professional opinion on the date it is given.

We will treat the documents and information you send us as confidential and use them only to carry out the Audit and to keep our records. If you need to rearrange your consultation, please tell us at least 24 hours before it takes place. If you do not attend or give less notice, we may charge you a new fee to rebook.

11. Cancellations and refunds

Products. The Products are digital files made available for download immediately. Once your download link has been issued, we cannot take the files back, so we do not offer a refund because you have changed your mind. If a file is faulty, will not open, or is materially different from its description on the FORS page, tell us within 30 days of delivery. We will repair or replace it, or, if we cannot, refund the price you paid.

The Audit. You may cancel for a full refund at any time up to 24 hours before your consultation. After the consultation has taken place or we have started reviewing your documents, the fee is not refundable. If we cancel the Audit, we will refund the full fee.

Consumers. If you are a consumer, you normally have a right to cancel within 14 days of purchase. By completing your purchase you expressly ask us to begin supplying digital content or the Audit immediately, and you acknowledge that you will lose your right to cancel once we start to supply the digital content, or once the service has been fully carried out. Your other statutory rights are not affected.

12. Guidance only, and no guarantee of accreditation

The Products and the Audit provide general guidance. They are templates and independent advice that you must adapt to your own operation, premises, people and vehicles. They are not legal advice, and you should check the current position, your customers’ requirements and your insurer’s requirements before relying on them. Law, guidance and the FORS Standard change.

HGV Consult is independent. We are not affiliated with, endorsed by or approved by FORS. Using our documents does not guarantee accreditation, a successful audit or compliance with any law.

13. Our liability

Nothing in these terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot lawfully be limited.

Subject to that, we are not liable for any indirect or consequential loss, or for loss of profit, loss of business, loss of contracts, loss of accreditation, or fines and penalties, arising from your use of the Products or the Audit. Our total liability to you for all claims relating to a Product or the Audit is limited to the price you paid for that Product or Audit.

14. Your information

We use your name, email address and order details, including a record of your downloads, to supply your order, to keep our records and to send you updates, as explained in our Privacy Policy. Stripe processes your payment and provides us with limited details about it.

15. Events outside our control

We are not responsible for delay or failure caused by events outside our reasonable control, such as a failure of the internet, email or payment services. If an event continues for a long time, either of us may cancel the affected order and we will refund anything you have paid for something we have not supplied.

16. Changes to these terms

We may update these terms. The terms that apply to your order are those shown on this page when you bought.

17. Governing law

These terms, and any dispute connected with them, are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction.
